A man has been found guilty of prostituting a 12-year-old girl to more than 100 men at his home in Hobart.

Gary John Devine, 51, was today sentenced in the Hobart Supreme Court to 10 years behind bars for organising for the girl to have sex with the men at his home in Glenorchy last year.

French book publisher sues Google


A French publishing group is to sue Google for publishing book excerpts online without permission.
La Martiniere accuses the technology company of "counterfeiting and breach of intellectual property rights" by digitising about 100 of its titles.

Google is scanning millions of books, allowing users to access the full text of works in the public domain or extracts from those under copyright.

The publisher is demanding 100,000 euros (£69,000) for each book involved.
La Martiniere owns the French company Le Seuil, along with Delachaux and Niestle in Switzerland and Harry N Abrams in the United States.

The lawsuit will be filed in a court in Paris and will target both Google France and its parent company, the American group Google Inc.

In a statement Google said the court case was not necessary as publishers could simply withdraw consent for their use in the service,

"We disagree with their case, which we will contest in court. Google Book Search helps users find and buy books - not read or download them for free."

The statement added: "It is directly beneficial to authors and their publishers because it enables them to reach a wider global audience, while protecting their copyrights.

Criticism of scheme

Google is attempting to copy every book in the collections of several major world libraries unless specifically denied permission to do so by the publisher of a title.

It has faced criticism from organisations such as the Association of American University Presses, which represents 125 non-profit-making academic publishers.



Users can search for full texts or extracts depending on copyright
It claimed the project could undermine sales of works to which publishers own the rights.
"In order for the suit to be effective, we have requested a penalty of 100,000 euros for each infraction discovered and for each day's delay," said Yann Colin, La Martiniere's lawyer.

"That means that if Google breaches a ban... imposed by the court at the end of the proceedings, it would cost Google very dear to carry on."

'Dominance' of English


The national publishers' union of France, Le Syndicat national de l'Edition, has repeatedly condemned the library project and threatened legal action.

There have been concerns in France that the project will enhance the dominance of the English language.

Last year, France and several other European countries received European Union backing for a rival book-scanning project for publications which are not in English.

Supporters of the Google project have argued in the past that copyright is protected because many of the works being scanned initially are old texts not by living authors.

Google is sued by Chinese author Mian Mian

A Beijing judge has told the Chinese novelist Mian Mian, who is suing Google over its plan to create an online library, to hold settlement talks.

After a two-hour hearing, the court ordered both sides to talk but did not set a deadline for reporting back, according to the author's lawyer.

She is seeking damages of 61,000 yuan ($8,950; £5,576) and a public apology.

The lawsuit was filed in October after Google scanned one of Mian Mian's books, Acid House, into its library.

Google said it had removed the book as soon as it learned of the lawsuit, but had no further comment on the case.

Mian Mian writes risque novels - including titles such as Panda Sex and Candy - about China's underworld of sex, drugs and nightlife. Most of her work is banned in China.

She is not alone in complaining about copyright issues raised by Google's online library. The China Written Works Copyright Society is also looking for compensation for other Chinese authors whose work is included in the project.

In France, a court ordered Google to stop digitising French books without the publisher's approval. The search engine was also told to pay 300,000 euros ($430,000; £268,000) in damages and interest to French company La Martiniere, which had sued for copyright infringement for scanning book excerpts.

In the US, Google agreed a $125m settlement with American authors and publishers - although this is still waiting for final court approval.

Google urged by Chinese writers to keep its promise

Last year, search engine Google came under intense fire from Chinese authors, as its digital library used books written by Chinese authors without permission. Google promised to offer a solution to the issue before the end of March 2010. Now Chinese authors are demanding the company fulfill its promise in time.

In November last year, the China Writers Association sent a notice to Google regarding its infringement on the rights of Chinese authors. One month later, Google delivered a list of Chinese books that it had scanned and stored in its online digital library. Among these books, 8 thousand were written by members of the China Writers Association. In January, Google made a public apology to Chinese authors, and offered a timetable to solve the issue. But on January the 12th, the company unilaterally postponed the fourth round of negotiations, and hasn't make any action since then.

Yang Chengzhi, China Writers Assoc., said, "Many authors have repeatedly asked us whether Google will break its promise. If Google respects Chinese authors' legal rights, we hope it will implement its promise which it sent to us in a formal text."

Since the disclosure of the issue, many Chinese authors have questioned Google's behavior.

Zhang Kangkang, China Writers Assoc., said, "The sharing of cultural resources should be based on respecting copyrights. Otherwise, it is just an excuse to illegally use other people's works."

In November last year, Google held three rounds of talks with the China Written Works Society. According to its preliminary list, 80 thousand Chinese books were included in its digital library. But the list was widely questioned, as it only covers books that were published after 1987.

Google's digital library comes under fire

Google has been greatly troubled over its digital library plan. The online collection has aroused opposition in many countries, as authors and publishers voice their doubts and concerns over the violation of copyrights. The Internet giant is now facing increasing lawsuits and warnings worldwide.

Google began setting up its digital library in 2004 to provide a service to American customers. In the past five years, it's put nearly ten million books online.

But insiders in the press as well as the publishing industry claim that Google has scanned books without authorization. And that constitutes a serious violation of copyrights.

In 2005, the digital library plan encountered resistance from US publishers. Since then, Google has faced many copyright hurdles, forcing a review of its actions.

And then the problem extended overseas. At the end of 2009, Japanese authors appealed to the government to ensure that any copies of Japanese publications would have authorization of copyright owners.

However, Google insists that its digital library plan doesn't violate copyrights.

Google's argument was refuted by a French court's rule that it infringed on copyrights by digitizing books and putting extracts online without authorization. The court in Paris ordered the Internet giant to pay over 300-thousand euros in damages and interest as well as stopping digital reproduction of material.

And since then, the lawsuits have been piling up. German chancellor Angela Merkel has stressed that Google should not be exempted from copyright laws.

US companies feel increasingly unwelcome in China because of what they see as discrimination and inconsistent legal treatment, according to a survey.

The American Chamber of Commerce in China (ACCC) found 38% of its members felt unwelcome, from 26% last quarter.

Inconsistent regulation and judicial treatment topped the list of concerns for American businesses, ACCC found.

It follows alleged cyber attacks on Google, and Chinese claims that the firm is too close to the US government.

Companies surveyed by the ACCC cited claims that Beijing wanted to squeeze foreign technology companies out of the multi-billion dollar market for selling computers and office equipment to government departments.

New rules stipulate sellers of high-tech goods must contain Chinese intellectual property as part of an "indigenous innovation" campaign, in order for them to be included in a government procurement catalogue.

"The survey shows that US companies believe they face product discrimination in state-owned enterprise purchases, as well as in government procurement," the survey said.

Of the American technology companies surveyed, 57% said they expected the preferential purchasing policy to have a negative impact on their operations in China while 37% said they were already losing sales.

Member-companies believed some policies in China were "increasingly restrictive and protectionist" which could limit foreign participation in the world's third largest economy, the survey said.

The survey was released as the trial opened in Shanghai of four employees of Anglo-Australian miner Rio Tinto on allegations of bribery and espionage.

The defendants were arrested last July during contentious iron ore contract negotiations that later collapsed.

Hi, guys, need some advice. I was going to go to the doctor for this original but since it seem to be getting better, I decided not to.

I woke up this Saturday with this sharp stabbing pain inside my left ear and then it disappear but when a e.g. burp the pain came back. It lasted throughout Saturday and Sunday.

And when I try to blow my nose, my ear felt like a black hole where everything is been sucked inwards

I was originally going to go to the doctors today. But when I woke up this morning it has gotten better, but now it itch like hell. I take it as getting better, so I didn't went to the doctors.

So, do any body have any input, advice for me?

The US president has reiterated his administration's offer of dialogue with Iran, but said that Tehran's leaders had "turned their backs" on previous overtures.

In a video broadcast on the internet on Saturday, Barack Obama also pledges to ensure that Iranians can get better access to the web without censorship.

"Even as we continue to have differences with the Iranian government, we will sustain our commitment to a more hopeful future for the Iranian people," Obama said in the video.

He told Iranians that "our offer of comprehensive diplomatic contacts and dialogue stands".

"Over the course of the last year, it is the Iranian government that has chosen to isolate itself, and to choose a self-defeating focus on the past over a commitment to build a better future."

The Turkish Prime Minister, Recep Tayyip Erdogan, has told the BBC that he believes Iran has no intention of developing nuclear weapons.

Mr Erdogan said he was confident Iran's nuclear programme was for civilian purposes only and described President Mahmoud Ahmadinejad as a "friend".

"I told him I don't want to see nuclear weapons in the region," he added.

Meanwhile, a top US general has said intelligence suggests Iran will not be able to build a nuclear bomb this year.

Gen David Petraeus, the head of US Central Command, said Tehran's weapon development programme appeared to have suffered delays.

"It has, thankfully, slid to the right a bit and it is not this calendar year, I don't think," he told a Senate committee hearing, according to the Reuters news agency.

Experts believe that Iran could enrich enough uranium for a bomb within a few months. However, it has apparently not yet mastered the technology of making a nuclear warhead.

Hundreds of women who came to the UK from South Asia to marry say they have been treated as domestic slaves by their in-laws, the BBC has learned.

More than 500 who applied for residence in 2008-09 after their marriages broke down were deported because they could not prove any abuse had taken place.

Police and charities are concerned the incidents are not reported because of family pressure and fear of reprisals.

The UK Border Agency said measures were in place to try to prevent such abuse.

'Bloodied nose'


The women complaining of being treated as slaves by their families come from India, Pakistan and Bangladesh.

One woman in her 20s says she was imprisoned by her mother-in-law for three years at their house in the north of England. She does not want to be named.

She has now started to come to terms with her ordeal, a year after her mother-in-law was prosecuted, but she says she still lives with the fear inside her.

"One day my mother-in-law beat me up really badly," she says.

"There was a lot of blood coming out of my mouth and nose - I couldn't tell anyone, call anyone or go anywhere.

"I used to get up at dawn and clean the whole house, scrub the floors, clean the windows, do the washing, cook. In between I'd have to sew."

She tried to kill herself twice. Eventually she managed to escape after her mother-in-law left her bedroom door unlocked.

"Staying inside all the time, not being allowed to watch TV or go out... I thought I'd rather be dead than live like this."

Research by Imkaan, the national charity for Black and Asian victims of domestic violence, shows how difficult it is for other Asian women to report abuse. It surveyed 124 women who use Asian refuges across the country.

"A woman may not speak English, may not be aware of what's available in terms of services, she may be in a situation where everywhere she goes her abuser or a family member - who may be colluding in the abuse - is actually going with her," says Imkaan director Marai Larasi.

"So her opportunity to disclose the abuse is compromised. There's also a real lack of services for women in this position."

There are concerns that this lack of reporting is leading many abused women from South Asia to eventually be deported when their marriages break down and they apply to stay in the UK.

Home Office rules state that any foreign national whose marriage breaks up within two years because of domestic violence can apply for indefinite leave to remain, but they must have reported the incident at the time to a person in authority - such as a GP or police officer.

Figures released by the Home Office show that more than half the number of South Asian brides who say they have been victims of domestic abuse in the UK have been deported in the last two years because they could not prove abuse had taken place.

Out of 980 applications for leave to remain in the UK in 2008 and 2009, only 440 women were allowed to stay.

In a statement, the UK Border Agency said: "We take our role in providing protection to women very seriously. We already have a number of measures in place to try and provide more directed support such as specific instructions, assessment of the quality of decisions and training for case workers."

After the highly-publicised case of Naseebah Bibi last year, Lancashire Police say they believe the problem is widespread in some communities.

Bibi was jailed for treating her three daughters-in-law as slaves at their home in Blackburn.

"The women are facing pressure, not only from immediate family but also their extended family abroad who may be relying on the people in this country to finance them to help improve their lives," says Lancashire Police's Det Con Dave Souch, who led the Naseebah Bibi inquiry.

His colleague Sgt John Rigby described it as the "Cinderella syndrome".

He adds: "The problem with slave labour, as it's been tagged, is probably far bigger than what we may expect - we can only go on the cases that are brought to our attention.

"But we know from the partner agencies we work alongside - like the Women's Aid Forums - who can tell you it's widespread."

Another woman, also in her 20s, was forced to flee her in-laws with her child. She was also too scared to reveal her identity.

She explained: "If I made tea, it was for her or someone else. I didn't have permission to drink tea with them because in the 15-20 minutes it would take, housework would not get done.

"She would swear at my family, and accuse me of taking things. If any money or jewellery had been misplaced I would get the blame."

She, too, was not allowed to speak to anyone outside of the family and was not allowed to go out by herself.

"Even a servant is allowed to have a break, but I was used like a machine," she recalls.

"The worst thing about it was that my husband wasn't there for me. I'd have done everything for him without complaining - but he didn't care about me or his baby."

She managed to escape after a year-and-a-half. She was rescued by her midwife, who alerted the authorities.

'Small proportion'

Parveen Javaid, domestic violence co-ordinator at Manchester-based Pakistani Resource Centre, said: "On average we deal with 20 to 30 cases a month where we give advice and support to women who are victims of mothers-in-law.

"The majority of cases I deal with are women who've been kept as slaves - abuse within the house."

To put this into context, just over 37,000 women have come to the UK on spousal visas in the last five years and while domestic violence workers say most of these marriages are genuine and successful, a small proportion of those marriages do fail.

What is clear is that this is still a hidden problem within South Asian communities.

It will remain so, unless women are encouraged to come forward and report it to the authorities.

Israel and Syria have announced ambitions to develop nuclear power plants to meet their energy needs.

Both countries laid out their plans at an international conference on civilian nuclear energy organised in French capital Paris on Tuesday.

Uzi Landau, the Israeli infrastructure minister, called Israel's need for nuclear energy "imminent" but gave no timeline for an atomic power plant.

"We need this energy source because it is environmentally clean," he told The Associated Press news agency.

Syria, which has been investigated by the UN nuclear watchdog over its alleged attempt to build a secret nuclear reactor, also said it would like to develop atomic energy.

Damascus needs "to consider alternative sources of energy, including nuclear energy," Faisal Mekdad, the deputy foreign minister, said.

Inspections

The conference, hosted by the Organisation for Economic Co-operation and
Development (OECD), was opened by Nicolas Sarkozy, the French president.

He called for more countries to adopt nuclear power to produce electricity, reduce greenhouse gas emissions and ease pressure on energy prices.

Israeli officials said France would supervise and provide technology for its new plant, in the northern part of the Negev desert.

"Naturally any nuclear power plant to be built in Israel will be subject to all the international safeguards," Landau said.

But Peter Crail, a non-proliferation analyst from the Arms Control Association, told Al Jazeera on Tuesday that it was likely much of the Israeli nuclear programme would come under inspection.

"There are issues that Israel will have to deal with in terms of how it will receive any form of cooperation from nucelar supplier states, such as in providing fuel", Crail said.

Israel has two nuclear reactors, one near the southeast city of Dimona that is widely believed to be used to produce atomic weapons, and a second research reactor at Nahal Soreq near Tel Aviv.

No UN inspector has ever set foot inside either facility and Israel refuses to confirm or deny that it has nuclear weapons.

The country is not a signatory to the nuclear non-proliferation treaty and has said it will not sign up for a Middle East nuclear-free zone being promoted by the United States.

'Secret reactor'

Syria's bid to join the nuclear club is likely to cause international concern, given the country's close ties with Iran and the still unanswered questions over an earlier alleged attempt to build a reactor in secret.

The International Atomic Energy Agency complained last year that Damascus had refused to co-operate with its investigation of a remote desert site in eastern Syria, which was bombed by Israel in September 2007.

The United States has said the facility hit by Israeli warplanes was a nearly completed reactor that, when on line, could produce plutonium, and, ultimately, nuclear arms.

But Damascus denies running a covert programme, and has maintained the site was an unused military installation.

Israel is expected to unveil plans this week to build a nuclear power plant, reports say.

They say an announcement will be made by Israeli Infrastructure Minister Uzi Landau at an energy forum in Paris.

Israel is facing a crisis over electricity supplies, but environmental objections have blocked efforts to build a new coal-fired plant.

Israel has two nuclear reactors, including the Dimona facility which is said to have produced nuclear weapons.

The secret reactor is located in the south of the country. Israel neither confirms nor denies having nuclear weapons under its policy of "ambiguity".

The other facility is a research reactor near Tel Aviv, which is open to international inspections.

Israel is not a signatory to the nuclear Non-Proliferation Treaty (NPT) which is designed to curb the spread of nuclear technologies with bomb-making potential.

'Joint project'

Mr Landau is expected to tell the conference in Paris that Israel is considering building a nuclear power plant, reports say.

He has reportedly discussed the possibility of co-operating in the project with French Energy Minister Jean-Louis Borloo, together with neighbouring Jordan.

France is one of the world leaders in electricity production from nuclear power.

In the 1950s, Paris helped Israel to build the Dimona facility.

Iranian President Mahmoud Ahmadinejad has accused the US of playing a "double game" in Afghanistan after the US used the same term to condemn Iran's role.

Mr Ahmadinejad said the US had "created terrorists and now say they are fighting them", as he appeared with Afghan President Hamid Karzai in Kabul.

US Defence Secretary Robert Gates, who is also in Kabul, has accused Iran of giving the Taliban low-level support.

Later, Mr Karzai flew to Pakistan for talks with another key neighbour.

This is Mr Ahmadinejad's first visit to Afghanistan since both he and Mr Karzai were re-elected last year.

At a joint press conference with Mr Karzai, Mr Ahmadinejad rejected the presence of foreign military forces "as a solution for peace in Afghanistan".

He said: "Our policy is full support for the Afghan people and Afghan government and reconstruction of Afghanistan."

Mr Gates, who is in Afghanistan to review the progress of the current Western troop surge against the Taliban, had earlier accused Tehran of "playing a double game" of offering friendship to the Afghan government while at the same time giving "low-level support" and money to the Taliban.

The Taliban are Sunni Muslims and sworn enemies of Shia Iran, which has growing interests and influence, particularly in western parts of Afghanistan.

Mr Ahmadinejad said it was the US that was playing the "double game".

"They themselves created terrorists and now they're saying that they are fighting terrorists," he said.

Mr Ahmadinejad criticised the US for its troops' presence, saying: "Your country is located on the other side of the world, so what are you doing here?"

Mr Ahmadinejad said that terrorism could not be defeated by armies, only by intelligence.

Here, is the catch, my philosophy in life is never let anybody get close to you or you ended up getting stab in the back.

Now, that is not always the case of course, but the idea is you should only let the right people get close to you and don't let the wrong people get close to you. But consdering the fact it is difficult to know who are the right people and who are the wrong ones, it is easier simply not let anybody get too close to you to begin with.

That is why I have no faith in family value, the first people that are able to hurt you if they choose to, would be your family, because their immidiate closeness to you. If you have the right family it is a good thing, if not...you are better off without a family.

Overall, your husband or wife is probably most likely to to hurt you, because after all, you and your partner aren't related, you have no blood relatioinship. But that doesn't mean your close family who you have blood relationship with, would not e.g. stab you in the back.

For example, to a greater extend, child abuse is still a common problem that exist within our society, where parent abuse their own children. To a lesser extend story such as e.g. Jack's brother Mike, sabotage Jack's opportunity to get a great job for his own gain or e.g. Sabrina intentionally steal her sister Mary's husband, aren't uncommon.

So, if you can't get the right family, then I would say you are better off without one.

(Personally, my mum have been nagging me to find a girl and settle down for years and in response I always crack a joke saying. "Mum I will do it, when I finally decide to pay as much allimony as Alan from Two and a Half man, someday.)

One thing our society frequently refer to conservative ideology is "Good old fashion conservative ideology."

Conservative ideology are frequently ideas that we were taught to believe in since we are a child, in prior to we have a chance to develop any ideas to begin with and we just passively absorb and spend the rest of our life carrying around these believes, believing in them passively, without ever question them. This are frequently been seen in communist countries too, where they brainwash children in school, to a particular set of value and children grew up passively believing these ideals without questioning them.

But the truth is that, conservative ideology is not necessary right. Ideas such as e.g. racism and sexism are all known to be a part of our coservative ideology and the conservative ideology of other cultures too, but they are definitly wrong. But conservative ideology is not necessary wrong they can be right too. e.g. you should not murder people or you should not have sex with other people's wife are also part of our conservative ideology too and they are right.

In other word, while we should not passively absorb everything conservative ideology ever told us, we should not rebel against it either. Instead, what we should be doing is to take our conservative ideologies out in the open and examing them base on facts and figures objectively and see whether they are right or wrong.

It is also important to understand different culture have different conservative idologies and they frequently clash with each other if you put them into comparison e.g. in europe we believe in Divin right of the King where in the middle east, they believe a king is a public servant.

Today, we are going to take a few western conservative ideologies into comparison with Confusious ideology and see who is right and who is wrong.

Here in the western conservative ideology, we believe in the concept of King is god's given right and we frequetnly refers to the Royal and none royal relationship to be Royals and Commoners.

In Confuscious ideology they believe a nation's policy should not put the interest of the King on the top but should put the interest of the people ahead of the King.

(Now, before our conservatives start accusing Confuscious to be a communist, lets start examing this base on the fact.)

Before, we began I must tell you a very important and valid ideal. The only thing that is relevant to make determination in regards to anything are the fact and figures and all determination should be made base on facts and figures, objectively only. Everything else are irrelevant trash. Take science for example, a theory is merely a theory and a theory can be wrong and we should not take a theory as a fact unless we have prove for it to be correct.

So now, lets get back to our original topic.

Firstly, I want to explain to you the concept of Signified and Signifier.

A Signifier is a linguistic term that signified an idea, but it have no real connection with the idea it Signified. For the example, the word Dog signified the idea of Dogness, but it have no real connection with a dog itself.

The term King, really only signified an idea but have no real connection wiht the man himself.

If we only make determination base on the facts and figures objectively, only and ignore everything else (As they are irrelevant.) it should soon become clear to you, that in reality a King and a President should be the exact same thing, the only difference is that in a democractic goverment structure, it is usualy call a President, Prime Minister or in the Acient Rome, Ceasor. In a dictator or semi dictatorship goverment structure, it is traditionally refers to as a King or an Emperor, whether good or bad dictator.(If any of you ever play StarCraft then remeber the character Acrturest Max, [I think that is how to spell his name] he is a perfect example.) But basically it is the exact same thing.

The concept of Royalty on the other hand, it is really something that is socially constructed, it doesn't exist by itself. The Royals are only royal because we believe they are royal, the day we seize believeing is the day they seize to be royal.

Of course, we can not denire the existence of Culture Capitals. The Culture Capital of a person, is the social status of that person. For example, the Culture Capital of Barack Obama is naturally different from a high school teacher and the cultre capital of a high school teacher will once again be different from a stripper and we can not denire the fact the member of the royal family do have pretty high culture capital in the current society, but that doesn't change the fact the concept of royalty is socially constructed.

So, back to our original question Conservative western idea believe in King is god's given right and divin right of the king, where Confuscious ideology believe that a nation's policy should not put the interest of the King on the top but should put the interest of the people ahead of the King.

So, who is more correct.

While because firstly, although we can not denire the royals do have a higher cultre capital then most people in the world and that they are the family or extended family of the King and Queen, the concept of royalty itself is socially constructed and only exist because we believe it exist, so in reality the royals are just commoners like the rest of us, nothing more.

Secondly, because stricly saying a King and a President should be the exact same thing.

I have to say, Confuscious ideology is more correct then in comparison to conservative ideology, on this one.

But don't feel bad, Western Conservative ideology have good valid things too for example, isn't it Jesus who said that we should love our enemy?

And Confuscious ideology have some wrong ideas too. e.g. Confuscious ideology is known to be really sexist.

Intelligence failures may have contributed to an upsurge in Taliban activity



I got a theory here, we lure Taliban troops to turn against their own with a tempting money offer.

I got this idea after one of my lecturer in Uni, whose mother was a prosetude, told us how people in that industry persuade pretty girls into doing that job. The principle there is simple, if you are able to offer enough money, you would be able to get some people to hook.

The same principle can apply here, if we are able to offer enough money, we would be able to get Talban informers. (But to ensure their copperation, we should let them know if they feed us false intel on purpose, we would kill them.)
