The Hicks Case becomes even more farcical as the Prosecutor admits he got it wrong.
David Hicks was Prisoner Number 2 at Guantanamo Bay and was the first to plead guilty under a plea bargain deal struck last year. Once described by successive Bush Administration staff as the ‘Worst of the Worst’ he was finally pleaded guilty to a much lesser charge of aiding a terrorist group. In the case the Prosecution Lawyer Colonel Moe Davis insisted that David was a foot soldier for the Taliban and should have been harshly punished. Instead the plea bargain delivered a much lighter sentence. Rumours of political interference by the then Australian Howard Government were strenuously denied.
Now the former prosecutor Davis has resigned from the controversial prosecution team he has come out with some shock revelations. He claims that the Hicks case was subjected to intense political interference. He also criticised the military commissions as being tainted by politics and using evidence obtained through coercion. Colonel Davis said that he was never interested in charging David Hicks as he was pretty minor and not worth charging. Yet he had inherited this case and the plea bargain was made without his knowledge.
Ironically Colonel Davis is now a witness for the defence in another anti-terror case.
In other statements Davis has said that abuse has been used to elicit evidence from prisoners.
